2/18/2009 -- Training on Appeals Hearings for Reduction in Staffing Hours for Section 21 Home and Community Based Waiver

Training for individuals and their guardians/family members, etc.

The training will cover the following topics:

  • The process for over median staffing reviews
  • Documentation required for the reviews
  • Tool the Department used to determind reduction in hours
  • How to ask for an extension for the appeal hearing
  • How to prepare for the appeal hearing
  • What happens in the hearing

DRC Staff will conduct this training.  We cannot give legal advice to individuals, but we can make ourselves available for some technical assistance after the training and may take some cases on a limited basis.  We are prioritizing cases by first representing people who are not Class Members and either do not have a guardian or have a state guardian.  We are also assessing cases for merit.
